He said securing an OCC trust charter would give EDX a competitive edge in servicing those institutions.\u00a0<\/p>\n<p>By operating under a national trust charter, crypto firms can operate across state lines under a single federal regulator, rather than obtaining multiple state money\u2011transmitter licenses, simplifying custody, settlement, and fiduciary services for digital assets.<\/p>\n<p>EDX\u2019s filing argued that the existing structure of many<a href=\"https:\/\/www.newsbtc.com\/news\/us-labor-department-eyes-401k-crypto-access-bitcoin-considered-in-new-rule\/\" target=\"_blank\" rel=\"noopener \"> digital\u2011asset platforms <\/a>concentrates multiple functions \u2014 brokerage, exchange, market\u2011making, and custody \u2014 within single vertically integrated firms, creating potential conflicts of interest and single points of failure.\u00a0<\/p>\n<p>The company said moving custody, asset management, and trade settlement into an OCC\u2011chartered national trust bank would provide customers with the \u201cmost secure regulatory structure possible,\u201d and would align digital\u2011asset market infrastructure more closely with the separation of duties customary in traditional equities and derivatives markets.<\/p>\n<p>The application places EDX among several crypto companies pursuing similar paths. In December of last year, five firms \u2014 including Circle (CRCL) and Ripple \u2014 received <a href=\"https:\/\/bitcoinist.com\/ripple-circle-secure-path-national-banking-charters\/\" target=\"_blank\" rel=\"noopener nofollow\">conditional approva<\/a>l for trust charters. However, not everyone in the financial sector supports that approach.\u00a0<\/p>\n<h2>Growing Bank Unease Over Crypto Trust Charters\u00a0<\/h2>\n<p>Some incumbent banks and industry groups have pushed back, concerned that expanding trust\u2011bank charters to crypto companies stretches the historical purpose of the charter and could introduce new risks.\u00a0<\/p>\n<p>Rebeca Romero Rainey, president and CEO of the Independent Community Bankers of America, <a href=\"https:\/\/bitcoinist.com\/occs-approval-crypto-charters-pushback-banking\/\" target=\"_blank\" rel=\"noopener nofollow\">warned <\/a>that conditional approvals could endanger consumers and create institutions that the OCC might struggle to regulate effectively.\u00a0<\/p>\n<p>She also argued that the new framework can permit stablecoin operators to access the federal banking system without meeting the same capital and regulatory standards required of full\u2011service, deposit\u2011taking banks.<\/p>\n<p>Yet, the OCC\u2019s leadership has defended the approvals.
